Friday in court, Robert Fassbender’s attorney, Michael Webb, tried to get the charges dropped before having to go to trial.

But the District Attorney’s Office plans to prosecute the case to the hilt, even if it means life in prison for Fassbender under California’s controversial three strikes law.

"I just hate to think that he's going to have to do the rest of his life in prison, but then that means he'll die in there and I don't want that,” said his mother, Marceline Fassbender.

The family said Fassbender is a reformed convict leading a Christian life, and is sometimes tortured by drug use.

"It's just hard and he's going to do life over donuts,” said Fassbender’s Brother, Eric. “It's just that my brother did so good for years and years and he took people from prison into his Christian home"

But Kern County District Attorney Ed Jagels said Fassbender has earned his third strike, with two previous felonies dating back to 1977 and 1999 for robbery.

Fassbender is scheduled for another hearing on Feb. 11.

This is the same state that finds illegal "immigration" to be conscionable, and lets murderers and rapists go free after serving only a few years.

Perhaps as offensive as the story itself is the jackass comment left by someone on the web site where it appeared:

What a dumbass. Instead of 25 to life, which could be costly, he should do at least 2 yrs. That way he has to explain to his peers behind the wall what a dumbass he really is for stealing donuts. Furthermore; I think the 2 yr package should include therapy. Shock therapy that is. Find something valuable that can,t be found in prison, present it to him and when he looks at it give him a nearly lethal high voltage jolt. Repeat daily for the next 2 yrs. Upon his release and for the duration of his parole make him go to meetings with the DA in town, Donuts Anonymous that is, chances are that he will either never go back to prison or he will never eat a donut ever again. what a dumbass.

Outrageous as it may be, this is not the first such case within the past year. See this story, and then this other one.

This is not fair! My dad has been a wonderful father for the majority of my life. He remained crime free for over twenty years, and if given the opportunity, i'm sure he would do it again! Thanks for reading this blog...let us know what you think.

Well, while we are all entitled to our own opinion, it is generally a good idea to get all the facts on something before making a comment or voicing how you feel. I think the "dumbass" in this case would be the moron making rude comments about my father. If you did your research, you would find that Robert Fassbender didn't intentionally steal the donuts. He thought that they were paid for by his friend. A person trying to steal something dosen't usually eat the evidence in front of the cashier knowing that he was in the process of commiting a crime. My dad is a wonderful father and a man with a lot of passion for helping people in need. So, next time you decide your the shit and you know whats up...please, do everyone a favor and actually read on a topic before posting. You should check yourself. Thank you. Danielle Fassbender

I DO hope you understand that the "dumbass" remark was made by someone on the KGET web site, not me. You will find the story linked at the beginning of my blog entry. Please make certain that you check in there and express your outrage where the perpetrator of that insult will read it. I am continuing to comment at KGET, but this story was worth reporting here, because it connects to two similar instances I'd reported, in which someone had found himself facing a grossly disproportionate punishment for an insignificant offense.

In short, it does not matter to me whether or not your Dad "stole" the donuts, although what you've reported makes the story all the more outrageous.

But there's another issue here, too.

I am appalled by the cruelty that people express via the anonymity of these Web comment groups. I've been following the stories of the numerous people who have died after being zapped with a police Taser. Every one of these stories has brought nasty remarks from people who seem as though they must occupy a parallel universe where compassion does not exist.

Mind you, I am no bleeding-heart. In fact I am a strong proponent of the death penalty for serious crimes. But I don't understand the rationale behind punishing someone severely for a minor crime, while letting rapists and murderers go free on plea-bargain deals, or get out of prison early on "good behavior" systems.

In your father's case, even IF he were guilty, the sentence is absurd, considering how much money will be spent on incarcerating him, compared with the monetary value of the item he is accused of stealing. Restitution, yes. Perhaps a monetary fine, and/or community service.

But if Robert Fassbender is a felon, what does that say about the millions of Americans who boost office supplies from work for personal use? (For example.)

Without meaning to sound flippant, your father is a poster-boy for what is wrong with the US justice system.
